Business customers
RevenueTrace services are intended primarily for businesses and people purchasing on behalf of a business or professional activity.
If you are purchasing as an individual consumer rather than for business purposes, please contact us before ordering. Nothing in these Terms limits rights that cannot legally be excluded.
Our services
RevenueTrace provides independent business and revenue diagnostic services.
Depending on the service purchased, we may review publicly available information, websites, customer journeys, conversion paths, aggregate business data, advertising data, traffic data, market information and other material supplied or authorised by you.
The exact scope of an engagement is determined by the service description, order confirmation and any additional scope agreed in writing.
RevenueTrace reports and recommendations
Our reports identify observations, potential revenue opportunities, risks, hypotheses and recommended tests based on the information reasonably available at the time of analysis.
RevenueTrace does not guarantee increased revenue, profit, conversion rate, advertising performance or any other commercial result.
Recommendations involve judgement and uncertainty. You are responsible for deciding whether and how to implement them and for monitoring their results.
RevenueTrace does not provide legal, tax, accounting, investment or regulated financial advice.
Information you provide
You agree to provide information that is reasonably accurate and relevant to the requested analysis.
You must have the necessary authority to provide any information or data supplied to us.
We aim to use aggregate business data rather than customer-level personal data wherever reasonably possible and do not require passwords to Shopify, Meta or similar platforms.
If personal data needs to be processed on your behalf, additional data-processing terms may apply.
Fees and payment
Prices are shown on our website or agreed before work begins.
Unless otherwise agreed, payment is due before analysis begins.
Any applicable taxes will be handled as required by applicable law.
Additional work outside the agreed scope will not be charged without your agreement.
Cancellation and refunds
If you ask to cancel before we begin substantive work, contact us at hello@getrevenuetrace.com and we will normally refund the amount paid.
Once substantive analysis has begun, any refund will take into account work already performed and costs reasonably incurred.
If we are unable to provide the agreed service, we will offer an appropriate refund for the part of the service that has not been provided.
This section does not affect any rights that cannot legally be excluded.
Client data and confidentiality
You retain ownership of the business data and materials you provide to us.
We will use confidential information only as reasonably necessary to perform the engagement, operate the service, comply with law and protect our legitimate interests.
We may use trusted service providers where necessary to deliver RevenueTrace. Our handling of personal information is described in our Privacy Policy and Data Handling information.
Intellectual property
Apple Capital Ltd retains ownership of the RevenueTrace name, methodology, frameworks, templates, processes and other pre-existing intellectual property.
Once the applicable fees have been paid, you may use the report and recommendations delivered to you for the internal purposes of your business and may share them with your employees, contractors and professional advisers as reasonably necessary.
You may not resell, reproduce commercially or present the RevenueTrace methodology or report template as your own product without our written permission.
Third-party platforms and information
RevenueTrace may analyse information relating to third-party platforms such as ecommerce, advertising, analytics or payment services.
We do not control these platforms and are not responsible for their availability, accuracy, changes, policies or performance.
Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence.
To the maximum extent permitted by law, RevenueTrace and Apple Capital Ltd will not be responsible for indirect or consequential losses, loss of opportunity, or losses resulting from business decisions made without appropriate independent judgement.
Subject to liabilities that cannot legally be limited, our total aggregate liability arising from a particular RevenueTrace engagement will not exceed the fees paid to us for that engagement.
Availability and changes
We may improve, modify or discontinue parts of RevenueTrace as the service develops.
Changes will not remove services already paid for without an appropriate alternative, credit or refund.
We may update these Terms from time to time. The version applying to an engagement will normally be the version published when the service is ordered unless otherwise agreed.
Governing law
These Terms and any dispute arising from them are governed by the laws of England and Wales, subject to any mandatory laws that apply.
Where legally permitted, the courts of England and Wales will have jurisdiction over disputes relating to these Terms.
